On January 1, 2015, the deferred part of the amendment to Act No. 341/2013, Coll., came into force. The amendment was adopted on October 10, 2013, but the effectiveness of one part (i.e. the first section of Part I. paragraphs 4, 7, 20, 21, 23, 29, 38, 41, 42, 43 and 45) was postponed until January 12, 2015. This part of the amendment is of a mostly formal nature; the following provisions are the most significant changes:
Sec. 74 (7) of the PPA: “The Ministry will nominate two members and two alternate members of the assessment committee, as per paragraph 6, based on the list of public procurement assessors. The contracting authority will randomly choose a member and an alternate from among the nominees.”
Sec. 156 (4) of the PPA: “The presentation of an opposing expert opinion is a condition for the government’s consideration of the grounds for a public contract under paragraph 3. The Ministry will arrange for the preparation of this opinion.”
