In its decision sp. No. 29 ICo 26/2012, the Supreme Court interpreted the significance of framework contracts and the consequences of withdrawing from these contracts for the individual contracts concluded under them. A framework contract “only” provides the rules for entering into particular contracts; thus, according to the Supreme Court decision, it does not create a binding relationship, and no receivables and duties arise under it for the contracting parties. These obligations only arise under individual performance contracts concluded under the framework contract. The framework contract is, hence, a kind of procedural instrument (which designates the future form of particular contracts), and it does not establish any particular claims of the parties. Withdrawing from a framework contract does not have any influence on the validity and effectiveness of individual performance contracts or the existence of claims under them.
